South Africa crypto regulations have expanded, and the impact will be felt far beyond South Africa Bitcoin holders. South Africa is establishing a playbook of crypto licensing laws for other countries to follow.

In May 2025, the High Court ruled crypto is not "capital" under South Africa's 1961 exchange controls. The state's answer was to rewrite the definition. The draft regulations compel declaration of holdings, forced sale at market value in rand, and, once assets are seized and forfeited, surrender of private keys under criminal penalty. Luno calls the mechanisms unconstitutional. And on July 1, SARS opened a second front: a crypto tax guide, a dedicated wallet-audit unit, and CARF data sharing behind it. South Africa Bitcoin regulation, South Africa crypto tax, and exchange controls are converging into one framework other governments will study.
